Student Waiver and Release of Liability

This waiver and release of liability is executed on {sign_date} by , referred to herein as "Member," in favor of Heavy Metal BJJ, LLC, a Brazilian Jiu-Jitsu academy located in Windsor, Colorado, referred to herein as "Gym."

Assumption of Risk

I, {name}, acknowledge that participating in Brazilian Jiu-Jitsu involves inherent risks, including but not limited to:

• Physical injury (e.g., strains, sprains, fractures, or other injuries);
• Accidental contact leading to cuts, bruises, or similar injuries;
• Risks associated with training, sparring, or competitions; and
• Other potential hazards associated with martial arts activities.

By signing this waiver, I voluntarily assume full responsibility for these risks and any harm, injury, or loss caused by my participation in Gym activities.

Release of Liability

I hereby release, discharge, and hold harmless Heavy Metal BJJ, LLC, it’s owners, instructors, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action, whether caused by negligence or otherwise, arising out of my participation in Gym activities.

Medical Clearance and Emergency Authorization

I certify that I am physically fit, have no known medical conditions that would impair my ability to participate in Brazilian Jiu-Jitsu activities, and have consulted a physician if necessary.

In the event of a medical emergency, I authorize Gym staff to secure emergency medical treatment on my behalf. I agree to bear any costs related to such treatment.

Photography and Video Consent

I understand that the Gym may take photographs or videos during classes, seminars, or events. By signing below, I consent to the use of my image and likeness for marketing or promotional purposes.

Member Responsibilities

As a member, I agree to the following:

• Follow all Gym rules and instructions;
• These rules include, but are not limited to: All members must check in before every class, and no kids (under 18) allowed in the weightlifting area unless Gym permission is granted and they are under adult supervision;
• Respect instructors, staff, and fellow members;
• Maintain personal hygiene and wear proper attire while participating.

Failure to comply may result in suspension or termination of membership.

Membership Terms and Agreement

This Membership Terms and Agreement is executed on {sign_date} by , referred to herein as "Member," in favor of Heavy Metal BJJ, LLC, a Brazilian Jiu-Jitsu academy located in Windsor, Colorado, referred to herein as "Gym."

Billing and Payment Terms

1. Non-Refundable Payments:
• All payments made are non-refundable under this agreement.
2. Payment Methods:
• Payments will be automatically charged monthly to the payment method on file.
• Failed payments will be reattempted 2, 4, and 7 days after billing date. Lack of payment past 10 days of billing date will incur a $15 late payment fee.
• Family member accounts will each receive a $10 per month discount.
• Bringing in a referral to the gym will provide you with a payment discount.
• The monthly fee is locked in for active accounts and will not undergo price increases for the length of the member’s membership. This includes account freezes, but not cancellations.
3. Early Cancellation Policy:
• Members may cancel anytime. However, cancellations under the unlimited sessions monthly plans are subject to the following:
• A $75 cancelation fee will be applied if canceled within the first month.
• A $50 cancelation fee will be applied if canceled within the second month.
• A $25 cancelation admin fee will be applied if canceled within months 3 – 12.
• After one year, no cancelation or admin fee will be applied.

Cancellation Exceptions

The Gym will consider exceptions to the cancellation policy on a case-by-case basis. Valid reasons may include, but are not limited to:

• Medical conditions preventing participation (documentation required).
• Relocation beyond a reasonable distance from the Gym (documentation required).

4.        Membership Freeze:

• Members may freeze their membership for a minimum of 2 weeks and a maximum of 3 months. There is no fee for freezing the membership.

Member Responsibilities

As a member, I agree to the following:

• Maintain updated payment information on file.
• Notify the Gym in writing of any changes to membership status.
• Comply with all Gym rules and regulations.

Failure to comply may result in suspension or termination of membership.

Acknowledgment and Agreement
